What are the reasons for relief from duty of the Chairperson of the National Assembly? Has the Resolution on relief from duty of the Chairperson of the National Assembly been adopted?

Under Article 5 of Regulation 41-QD/TW of 2021, consideration for relief of duty of the Chairperson of the National Assembly of Vietnam is based on one of the following cases:

- Be on disciplinary period by warning or reprimand, but reputation is reduced that the official cannot hold the assigned position.

- Be disciplined and reprimanded twice or more in the same term or within the appointment term.

- Have more than two-thirds of low-confidence votes at the prescribed polling period.

- Have two consecutive years of quality rating at non-completion of duties.

- Be concluded by a competent authority to be degraded in terms of political ideology, morality, lifestyle, "self-evolution", "self-transformation"; commit the prohibited acts for communist party members; violate the responsibility to set an example, adversely affecting his/her reputation and the agency or unit where she/he is working

- Be concluded by a competent authority to violate political standards according to regulations on protecting the Party’s internal politics eligible for relief of duty.

On April 26, 2024, at the Headquarters of the Central Committee of the Communist Party of Vietnam, the XIII Central Committee of the Communist Party of Vietnam held a meeting to consider and comment on personnel work.

Specifically, the meeting was held to consider the relief of duty of Comrade Vuong Dinh Hue, member of the Politburo, and Chairperson of the XV National Assembly of the Socialist Republic of Vietnam (2021 - 2026).

Comrade Vuong Dinh Hue is a key leader of the CPV and the State, has received basic training, matured from the grassroots level, and has been assigned to hold multiple important leading positions of the CPV and the State. However, according to the report of the Central Inspection Commission and the authorities, Comrade Vuong Dinh Hue violated the regulations on prohibited acts for communist party members, the Regulations on the responsibility to set an example for communist party members, officials, first of all, Member of the Politburo, Member of the Secretariat, Member of the Central Committee of CPV and responsible to the head under CPV regulations and laws of the State.

Comrade Vuong Dinh Hue’s violations and shortcomings have caused bad publicity, affecting the prestige of the CPV, the State, and the Comrade personally.

Recognizing his responsibilities to the CPV, State, and People, Comrade Vuong Dinh Hue has applied for resignation from assigned positions.

Based on current regulations of the CPV and State and considering the wishes of Comrade Vuong Dinh Hue, the Central Committee of CPV agrees to approve the resignation of Comrade Vuong Dinh Hue from the following positions: Member of the Politburo, Member of the XIII Central Committee of CPV, Chairperson of the XV National Assembly of the Socialist Republic of Vietnam (2021 - 2026).

On the afternoon of May 2, the 7th Extraordinary Session of the XV National Assembly was held at the National Assembly Building of Vietnam, Hanoi to implement the following contents:

- Consider the relief of duty of the Chairperson of the National Assembly of the Socialist Republic of Vietnam for the 2021-2026 term, approve the relief of duty of the position of a member of the National Defense and Security Council, and the dismissal of Mr. Vuong Dinh Hue from the National Assembly deputy of Hai Phong city.

After listening to the presentation of Mr. Vuong Dinh Hue's submissions and opinions, the National Assembly of Vietnam conducted discussions, voted by secret ballot and adopted:

- Resolution on relief from duty of the Chairperson of the National Assembly of the Socialist Republic of Vietnam for the term 2021-2026 for Mr. Vuong Dinh Hue, approval of the relief of duty of the position of a member of the National Defense and Security Council, and dismissal of Mr. Vuong Dinh Hue from the National Assembly deputy of the XV National Assembly.

What are the duties and powers of the Chairperson of the National Assembly of Vietnam?

Under Article 64 of the Law on Organization of the National Assembly 2014, the duties and powers of the Chairperson of the National Assembly of Vietnam are stipulated as follows:

Duties and powers of the Chairperson of the National Assembly
1. To preside over National Assembly sessions, to ensure the implementation of regulations on activities of National Assembly deputies and on National Assembly sessions; to sign for authentication the Constitution, laws and resolutions of the National Assembly.
2. To lead the work of the Standing Committee of the National Assembly; to direct the preparation of tentative agendas of and convene and preside over meetings of the Standing Committee of the National Assembly; to sign ordinances and resolutions of the Standing Committee of the National Assembly.
3. To preside over conferences of full-time National Assembly deputies and other conferences held by the Standing Committee of the National Assembly.
4. To convene and preside over conferences of the Chairperson of the Ethnic Council and Chairpersons of Committees of the National Assembly to discuss programs of activities of the National Assembly, the Ethnic Council and Committees of the National Assembly; when necessary, to attend meetings of the Ethnic Council and Committees of the National Assembly.
5. To maintain relations with National Assembly deputies.
6. To direct the use of the operation funds of the National Assembly.
7. To direct and organize the implementation of the National Assembly’s external relations work; to represent the National Assembly in its external relations; to lead activities of Vietnamese National Assembly delegations in international and regional inter-parliamentary organizations.

Thus, the Chairperson of the National Assembly of Vietnam shall preside over National Assembly sessions, ensure the implementation of regulations on activities of National Assembly deputies and National Assembly sessions; sign for authentication of the Constitution, laws, and resolutions of the National Assembly; and perform other duties and exercise other powers as prescribed above.

What are the standards of the Chairperson of the National Assembly of Vietnam?

The new Chairperson of the National Assembly of Vietnam must meet the standards specified in Section I of Regulation 214-QD/TW 2020, specifically:

General standards:

- Politics and ideology:

+ Be absolutely loyal to the interests of CPV, the State - the nation, and the people; insist on Marxism-Leninism, Ho Chi Minh's thought, the goal of national independence and socialism, and the CPV's renovation line.

+ Have strong political stances, viewpoints, and bravery; resolutely protect the ideological foundation, the CPV's platform, the CPV's line, the Constitution, and the laws of the state; fight against wrong and hostile views

+ Have a passionate, deep patriotism; always put the interests of CPV, the nation, and the people above the interests of sectors, localities, agencies, and individuals; and be willing to sacrifice for the revolutionary cause of CPV, for the independence and freedom of the Fatherland, and for the happiness of the people.

+ Absolutely comply with the assignment of the organization and feel secure in the work.

+ Strictly maintain the discipline of speech by the CPV's principles and regulations.

- Ethics and lifestyle:

+ Be exemplary of moral qualities; live honestly, humbly, sincerely, purely, simply, and tolerantly; and need thrift, integrity, fairness, and impartiality; do not get ambition for power; be an enthusiastic and highly responsible worker; be a center of solidarity that is exemplary in all aspects.

+ Do not commit corruption, waste, opportunity, profit; resolutely fight to prevent and repel the deterioration of political ideology, morality, lifestyle, manifestations of "self-evolution" and "self-transformation" internally, bureaucracy, corruption, negativity, waste, rights, and group interests; absolutely do not profiteer and do not let relatives and acquaintances take advantage of their positions and powers for profit.

+ Strictly observe the CPV's organizational and disciplinary principles, particularly the principles of democratic centralization, self-criticism, and criticism; properly and fully exercise their powers and responsibilities and direct the strict implementation of principles, regulations, and procedures on cadre work; tenaciously combat manifestations and deeds in cadre work that are contrary to CPV and State regulations.

- Qualifications:

Have bachelor's degree or advanced political reasoning; state management of senior specialists or equivalent; appropriate foreign language and computer skills.

- Competence and prestige:

+ Have an objective, comprehensive, dialectical, and historically specific perspective; innovative thinking; strategic vision; scientific working methods; political acumen; have the ability to concretize and lead, direct, and organize the effective implementation of CPV's guidelines, guidelines, and policies, as well as the state's laws; and have the ability to summarize practice, conduct theoretical research, analyze data, and forecast effectively.

+ Firmly grasp the general situation and comprehensively understand the fields, areas, localities, agencies, and units assigned to manage and take charge.

+ Seize opportunities quickly; detect contradictions, challenges, new problems, difficult problems, limitations, and weaknesses in practice; and propose feasible and effective duties and solutions proactively.

+ Be dynamic, creative, industrious, and hardworking; dare to think, dare to do, and dare to take responsibility; have strong political determination, act decisively, and dare to face difficulties and challenges; saying goes hand in hand with doing; have outstanding achievements; specific results and "products" that contribute significantly to the development of industries, localities, agencies, and units; and be closely associated with the people and for the people.

+ Be the nucleus that gathers and promotes the political system's synergy; be highly trusted and trusted by ministers, CPV members, and the general public.

- Health, age, and experience:

+ Be physically fit to perform duties; ensure the age of appointment and introduction of candidates is by CPV rules.

+ Have had experience with and successfully performed the responsibilities and duties of the title of leader and key manager of direct subordinates; have extensive practical experience.

Specific standards:

- Meet the general standards of members of the Politburo and the Secretariat;

- Have high prestige, be the center of unity in the Central Committee, the Politburo, the whole CPV, the National Assembly, and the people;

- Be decisive in leading and administering according to assigned functions, duties, and powers;

- Have outstanding and comprehensive capacity in all fields of work, especially in strategic planning of socio-economic development, defense, and security and in directing the institutionalization of the CPV's guidelines, lines, and resolutions on law making, law enforcement supervision, and decisions on important issues of the country;

- Ensure democracy, fairness, openness, and transparency, representing the will and aspirations of all classes of people and ensuring that all state power belongs to the people;

- Have a deep understanding of Vietnam's legal system, international laws and practices;

- Be able to manage the quality and efficiency of meetings of the National Assembly and the Standing Committee of the National Assembly;

- Have experienced and successfully completed their duties in the position of provincial secretary, member of a committee, or head of a central department, ministry, or branch; joined the Politburo for a full term or more; in special cases, the Central Committee of CPV shall decide.
