In Vietnam, what is the press release on the results of the 7th extraordinary session of the XV National Assembly held on the afternoon of May 2, 2024?

On the afternoon of May 2, the General Secretary of the National Assembly issued Document No. 3566 on publishing a press release on the results of the 7th extraordinary session of the XV National Assembly.

On the afternoon of May 2, the 7th Extraordinary Session of the XV National Assembly was held at the National Assembly Building of Vietnam, Hanoi to implement the following contents:

- Consider the relief of duty of the Chairperson of the National Assembly of the Socialist Republic of Vietnam for the 2021-2026 term, approve the relief of duty of the position of a member of the National Defense and Security Council, and the dismissal of Mr. Vuong Dinh Hue from the National Assembly deputy of Hai Phong city;

- Consider the dismissal of Mr. Duong Van Thai of the National Assembly delegation of Bac Giang province from the XV National Assembly deputy;

After listening to the presentation of Mr. Vuong Dinh Hue's submissions and opinions, the National Assembly of Vietnam conducted discussions, voted by secret ballot, and adopted the Resolution on relief from duty of the Chairperson of the National Assembly of the Socialist Republic of Vietnam for the term 2021-2026 for Mr. Vuong Dinh Hue,

The National Assembly of Vietnam also approved the relief of duty of the position of a member of the National Defense and Security Council and the dismissal of the National Assembly deputy of the XV National Assembly for Mr. Vuong Dinh Hue.

At the same time, the National Assembly passed a resolution to dismiss the National Assembly deputy for Mr. Duong Van Thai.

On April 26, 2024, at the Headquarters of the Central Committee of the Communist Party of Vietnam, the XIII Central Committee of the Communist Party of Vietnam held a meeting to consider and comment on personnel work.

Specifically, the meeting was held to consider the relief of duty of Comrade Vuong Dinh Hue, member of the Politburo, and Chairperson of the XV National Assembly of the Socialist Republic of Vietnam (2021 - 2026).

Comrade Vuong Dinh Hue is a key leader of the CPV and the State, has received basic training, matured from the grassroots level, and has been assigned to hold multiple important leading positions of the CPV and the State.

However, according to the report of the Central Inspection Commission and the authorities, Comrade Vuong Dinh Hue violated the regulations on prohibited acts for communist party members, the Regulations on the responsibility to set an example for communist party members, officials, first of all, Member of the Politburo, Member of the Secretariat, Member of the Central Committee of CPV and responsible to the head under CPV regulations and laws of the State.

Comrade Vuong Dinh Hue’s violations and shortcomings have caused bad publicity, affecting the prestige of the CPV, the State, and the Comrade personally. Recognizing his responsibilities to the CPV, State, and People, Comrade Vuong Dinh Hue has applied for resignation from assigned positions. Based on current regulations of the CPV and State and considering the wishes of Comrade Vuong Dinh Hue, the Central Committee of CPV agrees to approve the resignation of Comrade Vuong Dinh Hue from the following positions: Member of the Politburo, Member of the XIII Central Committee of CPV, Chairperson of the XV National Assembly of the Socialist Republic of Vietnam (2021 - 2026).

What are the procedures for relief of duty of the Chairperson of the National Assembly of Vietnam?

The procedures for relief of duty of the Chairperson of the National Assembly shall comply with the instructions in Clause 1, Article 43 of the Rules of the National Assembly Session promulgated together with Resolution 71/2022/QH15 as follows:

- The agency or person competent to recommend to the National Assembly of Vietnam for election submits to the National Assembly of Vietnam for relief of duty;

- National Assembly deputies discuss at the National Assembly Delegation; The Chairperson of the National Assembly may meet with the Heads of National Assembly Delegations to discuss relevant matters;

- Representatives of competent agencies or persons report to the National Assembly of Vietnam on the explanation and reception of opinions of National Assembly deputies at the National Assembly Delegations;

- The National Assembly of Vietnam discusses. Before the National Assembly discusses, the person proposed for relief of duty, the person proposed for dismissal or removal from office has the right to express their opinions;

- The National Assembly of Vietnam establishes the Vote Counting Committee;

- The National Assembly of Vietnam relieves of duty, dismisses or approves a proposal for relief of duty or removal from office by secret ballot;

- The Vote Counting Committee reports the vote counting results and voting results;

- The Standing Committee of the National Assembly submits to the National Assembly a draft resolution on relief of duty, dismissal, or approval for a proposal for relief of duty or removal from office;

- The National Assembly of Vietnam discusses;

- The Standing Committee of the National Assembly reports to the National Assembly on the explanation, reception of opinions of National Assembly deputies and correction of the draft resolution;

- The National Assembly of Vietnam votes to adopt the draft resolution.

What are the regulations on holding extraordinary sessions of the National Assembly of Vietnam under the Law on Organization of the National Assembly 2014?

Under Article 90 of the Law on Organization of the National Assembly 2014:

National Assembly sessions
1. The National Assembly shall hold its sessions in public.
The National Assembly may, when necessary and at the proposal of the President, Standing Committee of the National Assembly, Prime Minister or by at least one-third of the total number of National Assembly deputies, decide to conduct a closed session.
2. The National Assembly shall hold two regular sessions a year.
The National Assembly shall hold an extraordinary session when so requested by the President, Standing Committee of the National Assembly, Prime Minister or at least one-third of the total number of National Assembly deputies.
3. The National Assembly shall discuss and decide on matters falling within its tasks and powers at its sessions according to the procedures provided in the Rules on National Assembly sessions and other related laws.

According to the above provisions of the Law on Organization of the National Assembly 2014, the National Assembly of Vietnam shall hold two regular sessions a year. The National Assembly shall hold an extraordinary session under request by the State President, Standing Committee of the National Assembly, Prime Minister or at least one-third of the total number of National Assembly deputies.
